Privacy Policy
Welcome to the Pomcor Web site. The Pomcor Web site comprises two different domains, pomcor.com and noflail.com. The domain noflail.com is used to host a Web application called Noflail™ Search. This Privacy Policy applies to the entire Site, including both domains.

By using this Web site, you accept the terms of this policy. If you feel our privacy practices are inadequate to protect your privacy or if you are under 13 years of age, you should refrain from using our website.

This privacy policy may, in Pomcor's sole discretion, be modified periodically, so you should review this privacy policy on a regular basis. Your continued use of the Site and/or the Noflail Search application signifies that you continue to accept the terms of this Privacy Policy, as revised from time to time.

The Noflail Search application is built on the Adobe Flex® platform, and runs in your computer, interpreted by the Adobe Flash® plug-in for your browser. Queries that you submit are sent directly from your computer to third-party search engines to obtain results that are then displayed to you. Two different methods, with different privacy implications, are used to send queries to third-party search engines.

The first method consists of sending the query through a Web API provided by the third-party engine, obtaining results from the Web API, and displaying those results in the Results panel of Noflail Search. This method is used when you submit a query to an engine listed in bold-face in the Engines panel of Noflail Search, and in particular when you submit a query to the Microsoft® Bing™ search engine, which is the default search engine of Noflail Search. When this method is used, the third party obtains your IP address and TCP port, as well as information that identifies the browser you are using and low-level connection information that may identify the operating system you are using. Pomcor has no control over how such data is used by third-party Web API providers. Do not use the Noflail Search application if you have any concerns over the privacy of such data.

The second method consists of sending an HTTP GET request to the Web site of the third-party search engine, with your query embedded in the URL of the request, and displaying the Web page that the search engine produces in response to the request in a pop-up window. This method is used when you submit a query to an engine that is listed in normal (not bold) face in the Engines panel, and when you click on the name or icon of a search engine in the title bar of the Results panel. Using this method provides the third-party search engine with the same information as if you had visited the search engine's site without mediation by Noflail Search and submitted the query directly on the engine's site. Such information may include cookies previously set in your browswer by the engine's site. Information may also be provided to fourth parties that include content in the response page, such as ad networks. By using Noflail Search you agree that Pomcor is not responsible for any collection or use of data by third or fourth parties resulting from the use of this second method.

One or more pages in the Pomcor Web site, in the domain pomcor.com and/or in the domain noflail.com, may include an AddThis™ button, labeled SHARE, provided by AddThis LLC that you can use to tell others about, or to bookmark, the Site and/or the Noflail Search application. AddThis servers may collect your IP address and other information about you, including personally identifiable information that AddThis may request from you. Pomcor is not affiliated with AddThis and has no control over the collection and use of such data by AddThis. By clicking the button you agree that Pomcor is not responsible for any collection or use of data by AddThis.

The Noflail Search application allows you to retain queries in a Search History panel. Retained queries are stored locally (in your computer or in a file system accessible from your computer), using the local storage facility provided by the Adobe Flash plug-in. Retained queries are not accessible to third parties except if and when they are submitted again.

The Noflail Search application also allows you to export queries and results to a social bookmarking or sharing service. You can choose what service you want to use for this purpose from a menu. Pomcor provides the export facility for your convenience, but is not affiliated with and does not endorse any of the services listed in the menu. Pomcor has no control over privacy practices of the services. By using the export facility you agree that Pomcor is not responsible for any misuse of your data by the services.

At this time, Pomcor itself collects no personally identifiable information of visitors. Pomcor collects the IP addresses of HTTP requests, as well as other nonpersonally identifiable information. This information is only used as needed to resolve technical problems, to improve our site, for forensic purposes, to make decisions about when to perform maintenance and upgrades, to defend against Internet attacks, and for other similar purposes.
